PRIVACY NOTICE
 
This Privacy Notice explains how I collect, store and use your personal information in accordance with UK data protection law. For the purposes of data protection law, I am the Data Controller responsible for deciding how your personal information is collected, stored and used.  My contact details are: Lesley Lockie, [email protected], 07423 602905.

As a counsellor, it is my professional duty to record client information. Your client records will be retained for 7 years, after which they will be securely disposed of. Records may be retained for a longer period where there is a legal, regulatory, insurance, safeguarding or complaint-related reason to do so.
 
I hold the information you provide on the Kiku practice management system (www.wearekiku.com). This may include your name, address, phone number, date of birth, email address, emergency contact details, GP details and medical information. Brief client notes are recorded after each session, providing a factual summary of the session and any verbal agreements.
 
This client information and counselling records are securely stored using the Kiku practice management system. Kiku sends secure electronic forms for the collection of new client information and stores client records and session notes. Kiku acts as a data processor on my behalf, and I remain responsible for determining how your personal information is used.
 
I use a password-protected mobile phone for counselling communication. Client telephone numbers are stored using a client code to further protect identity. Communication may take place by telephone, text message and WhatsApp. I also use a dedicated and password-protected email account for counselling communication.
 
Whilst reasonable steps are taken to protect your information, communication by email, text message, WhatsApp and Microsoft Teams, including online counselling sessions, cannot be guaranteed to be completely secure.
 
I receive confidential supervision, which is a standard professional practice, in which I use your client code and avoid unnecessary identifying information to safeguard your identity. Your contact details are used solely for communication purposes. Other personal data, such as your name, address and/or date of birth, may be used to verify your identity when necessary for contacting your GP or in legal situations. Your client code is used for my annual accounts records.
 
I have established a clinical will, which designates a trusted counsellor to access client contact information (on the Kiku practice management system) where necessary to notify current clients should something happen to me. This person is bound by the same professional and confidentiality obligations as myself. In addition, my next of kin has been provided with instructions regarding the secure destruction of any client-related electronic files held on my personal computer and any archived historical paper records held in a locked cabinet in my home office, in accordance with data protection and confidentiality requirements.
 
The lawful basis for processing your personal information is the provision of counselling services and the management of those services. As counselling involves the processing of health-related information, special category personal data may also be processed where necessary for the provision of counselling services.
 
You have the right to request access to your personal information, which will be provided within one month upon receipt of a written request. You also have the right to request correction of inaccurate information and, in some circumstances, erasure of your information, unless there are professional, legal or regulatory grounds for retention.
 
As outlined in our counselling agreement, I reserve the right to share information under specific conditions:
  • Upon your request, when release is not deemed harmful to another person.
  • Where there is a specific legal requirement for me to do so.
  • Where there is an ethical duty for me to do so, for example, to avoid serious harm to yourself or another person, including the safeguarding of children or vulnerable adults.
 
Upon conclusion of our counselling work, archived records will be stored securely on the Kiku management system for the retention period outlined above.
 
If you have any concerns regarding the handling of your personal information, please discuss this with me in the first instance and I will make every effort to resolve the matter. I will acknowledge your concern and aim to respond within 30 days. If you remain dissatisfied, you have the right to complain to the Information Commissioner's Office (ICO), or to my professional bodies, the British Association for Counselling and Psychotherapy (BACP) or the Association of Christians in Counselling and Linked Professions (ACC).
 
In the unlikely event of a personal data breach, I will assess whether notification to the Information Commissioner's Office and affected individuals is legally required and will act in accordance with UK data protection law.
